The Shared Perception of Social Contexts and Its Conditions for Possibility.Alessio Lo Giudice - 2009 - Ratio Juris 22 (3):395-415.
Pragmatist reinterpretations of both deliberative‐communicative theory and legal positivism point out the mentalist fallacy entailed by these prevalent models. I argue that pragmatist approaches imply analogous erroneous beliefs since they presuppose as given the shared perception of social contexts. Therefore they take for granted the shared interpretation of social problems and shared selection of common goals. Hence I advance the necessity of inquiring into the possibility conditions for a shared perception of social contexts. This would entail the organization of institutional (...)

    The Constituting Value of a European Democratic Experimentalism.Alessio Lo Giudice - 2018 - Contemporary Pragmatism 15 (4):453-475.
John Dewey conceived democracy as a cooperative problem-solving practice in which actors try out provisional solutions by means of social communication. His notion of experimental democracy as a specific form of life and an ethical enterprise rather than simply a form of government implies the constitution of a polity as a practical and complex process of exchanging and sharing experiences. The aim of this paper is to test the feasibility of using a Deweyan theoretical basis for democracy to assess the (...)

-/- When the library becomes a confessional. The article (...)

Conceptual Analysis and its Critics.Michael Giudice - 2012 - Problema. Anuario de Filosofía y Teoria Del Derecho 1 (6):3-38.
Several criticisms exist surrounding the philosophical method of conceptual analysis in legal theory, but three have become particularly prominent in the last two decades. First, there are those who argue that the sheer diversity of types of law renders the pursuit of a single, overarching concept of law absurd. Second, there are those who suppose that engagement in con ceptual analysis cannot resolve boundary disputes about the concept of law, which was the very purpose of conceptual analysis in the first (...)

Legal System, Legality, and the State: an Inter-Institutional Account.Keith Culver & Michael Giudice - 2008 - Problema. Anuario de Filosofía y Teoria Del Derecho 1 (2):85-125.
Abstract:We aim in this paper to explore several related challenges to contemporary analytical legal theorists who accept as theoretically foundational the state-based view of legality and legal system advanced by H.L.A. Hart. We contend that this approach contains internal explanatory problems which limit the view’s capacity to account for novel prima facie legal phenomena outside the typical experience of the law-state. We supplement the analytical approach by advancing the rudiments of what we call an ‘inter-institutional theory of legality,’ a theory (...)

Pulling Off the Mask of Law: A Renewed Research Agenda for Analytical Legal Theory.Keith Culver & Michael Giudice - 2011 - Problema. Anuario de Filosofía y Teoria Del Derecho 1 (5):81-116.
This article identifies and advocates one part of a renewed research agenda for analytical legal theory: a renewed ‘relational’ approach to characterization of the concept of law, following the lead set by Hart’s exploration of law’s relation to morality, coercion, and social rules. We advocate further descriptive-explanatory investigation of law’s relation to security, environment, and information technology, in the context of state and extra-state legal orders. This investigation is responsive to emerging legal phenomena as identified by the inter-institutional account of (...)

: Autonomous driving systems promise important changes for future of transport, primarily through the reduction of road accidents. However, ethical concerns, in particular, two central issues, will be key to their successful development. First, situations of risk that involve inevitable harm to passengers and/or bystanders, in which some individuals must be sacrificed for the benefit of others. Secondly, and identification responsible parties and liabilities in the event of an accident. Our work addresses the first of these ethical problems. We are (...)

In the last 2500 years, since the beginnings in ancient Greece of the literary genre we call “history,” the relationship between history and law has been very close. True, the Greek word historia is derived from medical language, but the argumentative ability it implied was related to the judicial sphere. History, as Arnaldo Momigliano emphasized some years ago, emerged as an independent intellectual activity at the intersection of medicine and rhetoric. Following the example of the former, the historian analyzed specific (...)

The Golden Standard of Concepts with Necessary Conditions and the Concept of Law.Enrique Cáceres Nieto - 2012 - Problema. Anuario de Filosofía y Teoria Del Derecho 1 (6):39-50.
In this paper I argue against the thesis defended by Michael Giudice, who claims that it is possible to provide a concept of law by determining the necessary conditions of its essence. My main thesis is: 1) that this goal can exclusively be reached with certain kind of concepts: those satisfying what I propose to call:“Golden Standard of Concepts with Necessary Conditions” and 2) that the concept of “Law” is not such a concept. Therefore I defendmethodological pluralism in opposition (...)

Democratic Confederalism: An Alternative for Facing Tensions Between Global Citizenship and Localist Citizenship.Luis Xavier López-Farjeat & Tatiana Lozano Ortega - forthcoming - Problema. Anuario de Filosofía y Teoria Del Derecho.
This article explores the tensions between different conceptions of “citizenship.” On the one hand, we point out the virtues and limitations of cosmopolitan citizenship in the terms in which Seyla Benhabib understands it in The Right of Others…; on the other hand, we delve into another notion of citizenship, namely, the localist, in a version that could be at odds with some cosmopolitan values, that is, localism as understood by some Mexican autonomous communities, particularly the Zapatistas. Although Benhabib’s cosmopolitan federalism (...)

The spread and publicity given to questionable practices in the corporate world during the last two decades has fostered an increasing interest about the importance of ethical work for organizations, practitioners, scholars and, last but not least, the wider public. Relying on the Social Identity Approach, we suggest that the effects of different ethical climates on employee behaviors are driven by affective identification with the organization and, in parallel, by cognitive moral (dis)engagement. We compared the effects of two particular ethical (...)

Modell + Risiko: historische Miniaturen zu dynamischen Epistemologien.Anna Laqua, Peter Löffelbein & Michael Lorber (eds.) - 2019 - Wiesbaden: Harrassowitz Verlag.

The paper lays the foundations for a duty of sustainable property use based on Kant’s Doctrine of Right. In doing so, it contributes to the project of extending the application of Kant’s philosophy to environmental issues so as to include his legal-political philosophy. After providing some context, focusing in particular on Kant’s property argument, I present and critically evaluate a recent argument for a duty of sustainable property use, put forward by Attila Ataner. Then, I draw on Reinhard Brandt’s and (...)

The Ethics of Cultivated Meat.Luca Lo Sapio - 2022 - International Journal of Applied Philosophy 36 (1):27-39.
The ethics of cultivated meat is an emerging field of applied ethics. As the world’s population increases, stakeholders, scholars, and producers have begun to devise new strategies to meet growing food needs and to prevent food production from having a deleterious environmental impact. In this paper, I will focus on the main moral arguments against the production and consumption of cultivated meat. I will then frame some arguments to show that none of the objections to the production and consumption of (...)

    The Symmetry Regained.Tien-Chun Lo - 2024 - Analysis 84 (1):42-46.
Collin (2022) attempts to break the symmetry between the modal ontological argument for the existence of God and the reverse modal ontological argument against the existence of God by drawing on some Kripkean lessons about a posteriori necessity. He argues that there is an undercutting defeater for taking God’s non-existence to be possible. In this paper, I reply that taking the Kripkean considerations about a posteriori necessity into account does not help break the symmetry. For we can argue in a (...)
